AImagen Subscription Terms & Conditions

Terms of Use

Effective Date: March 2025

Welcome to AImagen, a mobile application developed and operated by Seyfi Can Zeyrek ("we", "us", or "our"). By accessing or using the App, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use AImagen. By using the App, you confirm that you are of legal age and capacity to enter into this agreement.

2. Description of Services

AImagen allows users to generate AI-powered images using a prompt-to-image system via:

  • Limited free use,

  • Token-based usage,

  • Advertisement-supported features,

  • Optional paid subscriptions.

We may change, modify, or discontinue features of the App at our sole discretion, without notice or liability.

3. Token System & Payments

  • Tokens are in-app credits used to access AI image generation and related features.

  • Tokens can be purchased via in-app purchases (IAP) or earned by watching ads.

  • All transactions are handled through the Google Play Store and are subject to its billing policies.

  • Tokens are non-refundable, non-transferable, and do not represent a monetary value outside the App.

  • Subscription plans renew automatically unless canceled at least 24 hours before the next billing cycle in your Google Play account settings.

4. User Responsibilities & Conduct

You agree that:

  • You will not use the App to generate illegal, harmful, explicit, defamatory, hateful, violent, or misleading content.

  • You are solely responsible for all content (text prompts, generated images, etc.) created or shared through your use of the App.

  • You will not attempt to reverse-engineer, scrape, exploit, or interfere with the App or its AI systems.

  • You will comply with all local and international laws regarding AI usage and content creation.

5. Intellectual Property & Content Ownership

  • You retain ownership of your prompts and generated images, to the extent allowed by law.

  • However, due to the nature of generative AI, you acknowledge that other users may generate similar or identical content.

  • You grant us a non-exclusive, royalty-free license to use anonymized user-generated content for moderation, model improvement, or promotional purposes.

  • You are solely responsible for ensuring that your content does not infringe any third-party intellectual property rights, including trademarks, copyrights, or likeness rights (e.g., celebrities, brands, etc.).

6. AI Content & Legal Liability

  • The App uses generative AI which may produce unpredictable or biased content.

  • We do not guarantee that generated content will be unique, appropriate, or lawful.

  • We disclaim all responsibility for:

    • Copyright infringement or legal claims resulting from user-generated content,

    • Misuse of the App for harmful or misleading outputs.

7. Moderation & Account Termination

We reserve the right to:

  • Suspend or terminate any user account without notice for violations of these Terms,

  • Restrict access to certain content or features,

  • Remove or report content that violates law or community standards.

8. Advertisements & Third-Party Services

  • The App may display advertisements or offer links to third-party services.

  • We are not responsible for the content, privacy practices, or functionality of these third-party offerings.

  • Your interactions with these third-party services are governed solely by their terms and policies.

9. Technical Disruptions & Liability Disclaimer

  • We do not guarantee that the App will be error-free, uninterrupted, or always available.

  • We are not liable for:

    • Loss of tokens, image outputs, or prompt data due to crashes, bugs, or server outages,

    • Any indirect, incidental, or consequential damages arising from the use or inability to use the App.

10. Privacy

Please refer to our Privacy Policy for information about how we collect, use, and protect your personal data.

11. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the App or other means. Continued use of the App after changes implies acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by the laws of the Republic of Turkey, without regard to conflict of laws principles. Disputes shall be resolved exclusively in the courts of Istanbul, Turkey.
